Terms of Service
These Terms of Service ("Terms") govern your access to and use of Masal.ai's website and platform (the "Service"), operated by Iqol Technologies Private Limited ("Masal.ai," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance
By accessing Masal.ai and connecting a Google Ads account or a Meta Business Portfolio, ad account, and Page, you agree to these Terms, and to Google's and Meta's own respective platform and API terms.
2. Service Description
Masal.ai provides an integrated marketing automation platform for real estate, currently consisting of:
- Website generation: generates a property website from the details you provide.
- Google Ads automation: creates and manages Search and Demand Gen campaigns via the Google Ads API.
- Meta Ads automation: creates and manages campaigns via the Meta Marketing API, using ads_management, business_management, and pages_manage_ads. Real estate campaigns are created under Meta's Special Ad Category for Housing.
- Creative generation: generates ad creatives matched to your property and target audience.
- Lead Centre: retrieves leads from your connected campaigns (via leads_retrieval for Meta, and your website's own lead form) and presents them in one place.
- WhatsApp Follow-up: sends automated WhatsApp messages, using approved message templates, to leads who explicitly opted in via your Meta Lead Form, via the WhatsApp Business Platform.
We may add new channels or capabilities in the future. Any such addition will be reflected in an updated version of these Terms and our Privacy Policy before it becomes active for your account.
3. Account and Client Onboarding
- You must own, or have genuine Partner access to, the Google Ads account, Meta ad account, and Page you connect.
- For multi-client management, you grant Masal.ai the relevant Business Manager and ad account access under your own Meta Business Settings, and the relevant access under your Google Ads manager account.
- You are responsible for obtaining valid consent from leads who submit their details through your Lead Ads forms or website, as required by Meta's and applicable law's own terms.
4. Real Estate and Housing Compliance
You agree that all campaigns created via Masal.ai for real estate are subject to Meta's Special Ad Category for Housing, and to any equivalent Google Ads housing-related policy. You will not attempt to bypass these targeting restrictions. Masal.ai applies the Housing category automatically where applicable; violation of this may result in ad rejection by Google or Meta, and suspension from our platform.
5. WhatsApp Compliance
- We will only send WhatsApp messages to users who opted in via your Meta Lead Form.
- We will only use WhatsApp message templates approved by Meta.
- We comply with WhatsApp Business Policy and its anti-spam requirements. We may suspend WhatsApp sending on your account if your spam rate exceeds Meta's own threshold, or if Meta flags your WhatsApp Business Account.
6. Permissions and Tokens
You grant us permission to store your encrypted access tokens to perform the automation you've authorized. Tokens are encrypted at rest. You can revoke access at any time, via Facebook Business Settings for Meta, or your Google Ads manager account settings for Google, which immediately stops any further automation.
7. Data Deletion
You can request deletion of your data at any time, at no cost, via hello@masal.ai or our Data Deletion Instructions page. We delete tokens, leads, and campaign data within 7 days of a verified request.
8. Fees
Fees for Masal.ai's own services are billed as per your subscription or service agreement. Ad spend on Google Ads and Meta Ads is billed directly to you by Google and Meta respectively, and is not included in our fee.
9. Acceptable Use
You will not use Masal.ai to create misleading real estate advertising, violate Google's or Meta's advertising policies, or scrape data beyond what our platform's own features provide. We reserve the right to suspend accounts that violate Google's or Meta's platform policies.
10. Disclaimer
Masal.ai is an independent marketing technology platform built on the Google Ads API and the Meta Marketing API. For our WhatsApp Follow-up service specifically, Masal.ai operates as a Meta Tech Provider under the WhatsApp Business Platform. We are not affiliated with, endorsed by, or sponsored by Google or Meta. Ad approval, delivery, message delivery, and lead quality are subject to Google's and Meta's own systems and policies, and we do not guarantee ad performance or conversion outcomes.
11. Limitation of Liability
The service is provided as-is. Our liability is limited to the fees you've paid us in the preceding 3 months. We are not liable for Google or Meta API outages, ad rejections, or account restrictions arising from your own content or account history with those platforms.
12. Termination
You may terminate at any time by disconnecting your Google and Meta account access. We may terminate for policy violations or non-payment. Upon termination, we delete your tokens within 7 days.
13. Governing Law
These Terms are governed by the laws of India, with jurisdiction in Bangalore, Karnataka.
